TERMS OF SERVICE FOR
THE UNLIMITED WEB NETWORK

By using services provided by the Unlimited Web Network, you agree to comply with our policies. Common sense is the best guide as to what is considered acceptable use. The Unlimited Web Network is not responsible for any damages arising from use or inability to use of the Unlimited Web Network’s services. The following abbreviation used in context of the Terms of Service is defined as follows:

"TUWN" The Unlimited Web Network (Us)

Client authorizes TUWN to charge all fees due to the submitted credit card or checking account.

TUWN will charge on behalf of the U.S. governing agency, InterNIC, US$20.00 to register a domain name which covers the first year. We currently bill at a rate of $20.00 a year thereafter. I understand that TUWN will submit my request for domain name registration but can not guarantee any name will be available at the time my application is reviewed by the appropriate agency. I agree to hold TUWN free and harmless from any liabilities or litigation that may arise from my domain name reservation.

Generally, conduct that violates law, regulation, or the accepted norms of the Internet community, whether or not expressly mentioned in the Policy, is prohibited. The Unlimited Web Network reserves the right at all times to prohibit activities that damage its commercial reputation and goodwill.

While TUWN shall make every reasonable effort to protect and backup data for customers on a regular basis, TUWN is not responsible for files residing on our servers. The customer is solely responsible for independent backup of data stored on TUWN's server and network. If TUWN needs and is able to restore the customer's files due to a file lost TUWN is not responsible for, TUWN may charge an additional fee for this service.

Due to the public nature of the Internet, all information should be considered publicly accessible and important or private information should be treated carefully. TUWN is not liable for protection or privacy of electronic mail or other information transferred through the Internet or any other network provider or its customers may utilize.

Customers will not be allowed to use excessive amount of CPU. The customers agrees that if they use more then their allocated bandwidth, they will be charged the regular fee for a bandwidth upgrade. Reselling web space to other 3rd parties, e-mail bombs, re-selling cgi access to other 3rd parties, and IRC daemons are strictly prohibited.

TUWN maintains control and any ownership of any and all I.P. numbers and addresses that may be assigned to the customer and reserves in its sole discretion the right to change or remove any and all I.P. numbers and addresses. Client shall keep the right to use the domain name even if client changes providers.

Unlawful Activities

TUWN's services may only be used for lawful purposes. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes but not limiting material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of non-acceptable content or links: "Pirated software", "Warez Sites", "Irc Bots", "Hackers programs or archives", "Copyrighted Digital Movie Copies (DIVX)" and "Mp3".

Non-legal activity in any form, including but not limited to activities such as unauthorized distribution or copying of copyrighted software, violation of U.S. export restrictions, harassment, fraud, trafficking in obscene material, drug dealing, and other illegal activities will not be allowed.

We will be the sole arbiters as to what constitutes a violation of this provision.

Violations of system or network security are prohibited, and may result in criminal and civil liability. Examples include, but are not limited to the following: Unauthorized access, use, probe, or scan of systems security or authentication measures, data or traffic. Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks. Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.

Good Conduct

No one shall post defamatory, scandalous, or private information about a person without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual property rights.

Spamming

Sending unsolicited mail messages, including, without limitation, commercial advertising and informational announcements, is explicitly prohibited. A user shall not use another site’s mail server to relay mail without the express permission of the site.

It is against TUWN policy for customers to use our servers to effect or participate in any of the following activities.
1. To falsify user information provided to TUWN or to other users of the service in connection with use of a TUWN service;
2. To send unsolicited mass e-mailings, if such unsolicited e-mailings provoke complaints from the recipients;
3. To engage in any of the forgoing activities using the service of another provider, but channeling such activities through a TUWN provided server, or using a TUWN provided server as a maildrop for responses;
4. To post to any Usenet or other newsgroup, forum, e-mailing mailing list or other similar group of list articles which are off-topic according to the charter or other owner-published FAQ or description of the group or list.

Consequences of Violation of Terms of Service

When TUWN becomes aware of an alleged violation of its Terms of Service, TUWN will initiate an investigation. During the investigation TUWN may restrict the customer's access in order to prevent further possible unauthorized activity. Depending on the severity of the violation, TUWN may, at its sole discretion, restrict, suspend, or terminate the customer's account and/or pursue other civil remedies. If such violation is a criminal offense, TUWN will notify the appropriate law enforcement department of such violation. TUWN does not issue service credits for any outages incurred through service disablement resulting from Policy violations.

All orders, sales, rents, time-frames, and terms are final. Once the service is ordered (i.e. by clicking the order button of the online order form) there are no refunds if the service contract is canceled by the customer before the regular expiration date / anniversary date. All server and hosting contracts are automatically renewed for another term unless a written notice of cancellation has been given by either party at least two weeks in advance of the renewal date / anniversary date. If no correct notice of cancellation will be given, all contracts will automatically be renewed for another term under the same conditions. If an account has been setup and the initial rent is not paid, TUWN has the right to immediately close the account and to refuse service. If a credit card payment is declined by the client's bank or if the rent is not paid on time, TUWN will charge a US $25 late fee for each payment-related suspension. If client disputes justified charges by provider on his/her credit card, TUWN has the right to immediately discontinue service.

Modification

TUWN reserves the right to add, delete, or modify any provision of this policy at any time without notice.
